Products Liability Results

The Products Liability team has represented W.R. Grace in over two dozen major property damage cases, alleging defective fireproofing due to asbestos, installed in hundreds of buildings across the country. Several of these cases sought damages in excess of $100 million and constituted some of the largest claims ever brought in the venued states. We have tried several such cases to verdicts--both asbestos property damage and personal injury cases, in both federal and state courts-- with favorable results to the client. Also in the asbestos products arena, we litigated to favorable resolution one of the largest insurance coverage actions brought in Minnesota, involving scores of insurance companies and product liability policies covering a two-decade time span.

Other clients represented in the products liability field have included major manufacturers of ladders, ATV's, bicycles, motorcycles, motor homes, construction equipment, personal health devices and home electrical tools.

The Products Liability group has also undertaken cases on behalf of scores of plaintiffs--bringing suit against certain large pharmaceutical manufacturers for marketing certain defective and dangerous drugs.

The firm recently resolved a series of personal injury claims on behalf of numerous plaintiffs and their families who were exposed to toxic releases from an industrial explosion at a major federal installation. These federal court lawsuits involved sophisticated expert opinions from numerous authorities in such areas as radiological cytogenetic testing, dispersion analysis, volatile chemical interactions in certain pressurized conditions, psychiatric diagnoses of post-traumatic-stress-disorder and other psychological disorders, and other unusual aspects of the conditions and results of the accident.

The Lockridge Grindal Nauen Products Liability Team recently obtained a favorable verdict, after a four week trial, producing a $50 million judgment against a major ag-chemical company in a national consumer fraud action involving agricultural herbicides. That matter is currently being appealed by the defendant after three favorable unanimous opinions to date from the Minnesota Court of Appeals and state Supreme Court.
