On April 12, 2019, LGN attorneys Brian Clark, Arielle Wagner, and Stephanie Chen led a discussion on antitrust litigation with economics students at Macalaster College. The discussion was part of Macalester’s Industrial Organization class and introduced students to types of anticompetitive behavior, applicable regulatory schemes, and case mechanics.

Macalester College is a private college located in St. Paul, Minnesota. It is a global leader among liberal arts colleges known for its highest standards for scholarship and its special emphasis on internationalism, multiculturalism, and service to society.

Brian Clark Presents at National eDiscovery Leadership Institute

On April 5, 2019, LGN partner Brian Clark presented at the National eDiscovery Leadership Institute (NeLI) on a panel entitled “Negotiating Discovery: Obstacles and Pathways to Success.”

NeLI was formed in 2014 to provide high quality educational opportunities to judges and legal professionals specifically focused on electronically stored information (ESI) and to encourage cooperation between and among the bench and the bar. NeLI aims to provide the very best full day eDiscovery program offered anywhere in the world. Brian Clark leads 4th Annual Complex Litigation e-Discovery Forum

LGN Partner Brian Clark led the 4th Annual Complex Litigation e-Discovery Forum (CLEF) last week at the Minneapolis Club. The event, which Clark co-founded in 2015, is a one-of-a-kind opportunity for complex-litigation attorneys to share experiences, and discuss lessons learned and best practices surrounding electronic discovery issues unique to the plaintiffs’ bar.

More than 70 attorneys from across the country attended the event.

LGN Attorneys take leadership role on Minnesota State Bar Association Antitrust Council

Anna Horning Nygren and Brian Clark were re-elected to the Minnesota State Bar Association’s Antitrust Council at the Antitrust Section’s annual meeting on May 23, 2018.

Craig Davis is completing his year as past chair of MSBA’s Antitrust Section, and was elected as an emeritus member of the Antitrust Council. He joins Joe Bruckner and Heidi Silton as emeritus members. Craig Davis also presented to the annual meeting on recent developments in class actions as part of a continuing legal education panel on “Antitrust Year in Review.”

Brian D. Clark has been named a Rising Star by Super Lawyers for the past three years and focuses his practice on plaintiffs-side antitrust class actions and e-discovery advice for businesses of all sizes. He leads the firm’s e-discovery practice group, and co-founded and serves on the steering committee for the Complex Litigation E-Discovery Forum, an annual gathering for plaintiffs-side complex litigation attorneys to discuss best practices for e-discovery. Brian has also taught an e-discovery seminar at the University of Minnesota Law School since 2014.

Brian graduated magna cum laude from the University of Minnesota Law School in 2009 where he was elected Co-Editor-in-Chief of the Minnesota Journal of International Law and was a member of the Order of the Coif. While in law school, Brian interned with the Honorable Judge Patrick J. Schiltz of the United States District Court for the District of Minnesota.

LGN attorney Brian Clark recently served on a panel with 3M Senior Counsel David Ernst and Senior Litigator Counsel for the United States Department of Justice, Antitrust Division Tracy Greer

The panel was part of a CLE organized by the Minnesota State Bar Association’s Antitrust Law Section. The CLE, E-Discovery & Antitrust Investigations: A Perspective from the Government, In-House and Outside Counsel, took place on December 12, 2017 and focused on the e-discovery challenges of a government antitrust investigation from the perspective of the government, in-house counsel, and outside counsel.

LGN attorney Brian Clark led last week’s Complex Litigation E-Discovery Forum (CLEF) at the Minneapolis Club, including leading a discussion regarding “Early Preservation Discussions & ESI Disclosures During Motions To Dismiss.” Clark was co-host of the invitation-only CLEF event, which he co-founded in 2015. It is a one-of-a-kind opportunity for complex-litigation attorneys to share experiences, lessons learned, and best practices to address electronic discovery issues unique to the plaintiffs’ bar. More than 55 attorneys from across the country attended.

The forum also included discussions on the topics “Best Practices for Plaintiff Document Collection,” “Proportionality Two Years After the Amendments,” “Privilege Logs & Privilege Battles,” and “Facilitating Collaboration Across Firms.”

Brian Clark speaks at Sedona Conference Working Group panel

LGN attorney Brian Clark joined Magistrate Judge Andrew Peck (S.D.N.Y.) and others on a panel at the Sedona Conference Working Group 1’s meeting in Minneapolis May 4-5, 2017. The panel’s topic was “Examining Amended Rule 34,” which the panel members are also drafting a primer for publication.

The 2015 amendments included several changes to Fed. R. Civ. P. 34 concerning making and responding to requests for production of documents and things. To aid practitioners in getting up to speed with the amendments to Rule 34 and putting them into practice, a Working Group 1 drafting team put together this “Federal Rule of Civil Procedure 34 Primer.” This Panel will discuss the Primer and the case law on Rule 34, and provide an opportunity for working group members to comment on the Primer before it is finalized and published.

LGN Attorneys elected to MSBA Antitrust Section

The Antitrust Section of the Minnesota State Bar Association elected Anna Horning Nygren to join its governing Antitrust Council last week.

The Antitrust Section also elected Heidi Silton as an emeritus council member. Emeritus members must be “council members who have served a distinguished term on the Council, including serving as a chairperson and completing their term(s) as Immediate Past Chairperson.” (Heidi joins LGN partner Joe Bruckner in achieving emeritus member status).

The Section also elected LGN attorney Brian Clark for another term on the Council.

Brian Clark joins board of Twin Cities Chapter of the Association of Certified E-Discovery Specialists

LGN attorney Brian Clark recently joined the Board of Directors for the Twin Cities Chapter of the Association of Certified E-Discovery Specialists (“ACEDS”). ACEDS is the member organization for professionals in the private and public sectors who work in the field of e-discovery. ACEDS is building a community of e-discovery specialists for the exchange of ideas, guidance, training and best practices, and offers e-discovery certification.
